Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Chile Colorado Mexican Grillwebsite and online ordering system (collectively, the “Service”). By using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to create an account or place an order. By using the Service you represent that you meet this age requirement and that any information you provide is accurate and complete.

Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms or that we believe have been compromised.

You may not create an account on behalf of another person without their authorization, or use another person’s account without permission.

Online Ordering and Payment

Pickup only

All orders placed through this Service are for in-store pickup at 208 N Main St, Winslow, IN 47598. We do not currently offer delivery. Orders must be picked up during our posted business hours.

Pricing and taxes

All prices are displayed in U.S. dollars. Indiana sales tax is automatically calculated and added to your order total at checkout. We reserve the right to correct pricing errors at any time before an order is confirmed.

Payment processing

Payments are processed by Stripe, Inc. Your card information is entered directly into Stripe’s secure form and is never transmitted to our servers. By completing payment you agree to Stripe’s Terms of Service.

Order confirmation

An order is confirmed only after your payment is successfully processed by Stripe. Placing items in your cart or beginning checkout does not constitute a confirmed order.

Cancellations and refunds

All sales are generally final once payment is completed, as orders are prepared fresh and promptly. If you have a concern about your order — such as a missing or incorrect item — please contact us directly as soon as possible. Refunds and cancellations are handled at our discretion.

Order availability

Online ordering is available only during posted business hours. We reserve the right to pause or disable ordering at any time due to kitchen capacity, closures, or other operational reasons.

SMS Text Message Consent

By placing an order and providing your phone number, you expressly consent to receive a single automated text message from Chile Colorado notifying you when your order is ready for pickup. This is a transactional notification only — we do not send marketing, promotional, or recurring text messages.

• Consent to receive this text is not a condition of purchase; however, without a valid phone number we cannot send you a pickup notification.
• Message and data rates may apply depending on your carrier plan.
• To opt out, reply STOP to any message we send. You may also contact us directly to request removal.
• Reply HELP for help or contact us directly.

Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulations.
• Attempt to gain unauthorized access to any part of the Service, our servers, or any connected systems.
• Scrape, copy, or redistribute content from this site without our written permission.
• Submit false, misleading, or fraudulent orders or account information.
• Interfere with or disrupt the integrity or performance of the Service.

Intellectual Property

All content on this site — including text, images, logos, menu descriptions, and software — is the property of Chile Colorado Mexican Grill or its licensors and is protected by applicable copyright and trademark law. Nothing in these Terms grants you any right to use our trademarks, logos, or other brand features without our prior written consent.

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Menu items, pricing, and availability are subject to change without notice. We make reasonable efforts to display accurate information but do not guarantee that all content is current or error-free.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CHILE COLORADO MEXICAN GRILL AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR ANY ORDER PLACED THROUGH IT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Indiana, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts located in Indiana.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Your continued use of the Service after a change constitutes your acceptance of the revised Terms.
